The data stated in the intellectual property registers must be current. First of all this is required for maintaining your registration. Also, having the right information will help you act faster during legal proceedings and ensure you are available to those who wish to contact you about your patent, trademark and/or design registrations.
Mergers and the selling of patents, trademarks or designs to third parties means consequences for the owner of the intellectual property rights. Such alterations must be recorded in the registers. Failing to do so will affect your registration. Our lawyers will be happy to advise you on the consequences and the measures to be taken (e.g. entering alterations in the register). Also, they can draw up the required agreements.
The required documents for registering transfers (such as deeds of assignment) usually need to be signed by all parties involved. We kindly advise you to arrange matters promptly (collecting signatures and introducing the change). In time it might be difficult to collect signatures on behalf of the party that has surrendered its rights, for instance in case a company no longer exists.
Licences may also be registered in the official registers. In some countries this is even a requirement. The lawyers of Nederlandsch Octrooibureau can help you register a licence in the official registers.
