Renewals

A Benelux design registration and a Community design registration (EU) both remain valid for a period of 25 years. Initial registrations are valid for a period of 5 years, with the possibility to extend registration for another 5 years each time.

If a design right is not renewed on time you will basically lose your rights. A second design application for the same design is impossible given the fact that this design will then no longer be considered new. The first design registration which has now expired would interfere with the registration of a second design because in such case the second design would not be considered new.

Nederlandsch Octrooibureau has an extensive and advanced database in which renewal deadlines are carefully monitored. If you decide to have us monitor your design registration, your design registration will automatically be included in this database, in which case and if necessary you will receive three reminders to inform you about the appropriate steps that you should be taking to extend your registration.
